Welcome to MaintFolio! By signing up for an account, accessing our platform, or using our mobile or web applications (collectively, the "Services"), you agree to be bound by the following Terms of Service and Disclaimers. If you do not agree to these terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using MaintFolio on behalf of a business (such as a Real Estate Agency, Home Inspection Company, or Service Provider), you represent that you have the authority to bind that business to these terms.

2. Asset Tracking & Insurance Disclaimer

MaintFolio provides a digital platform to help you organize and track your personal property, home infrastructure, and vehicles.

• Not an Appraisal: MaintFolio is an organizational tool. It is not an official appraisal, valuation, or comprehensive ledger guaranteed for insurance claims.
• User Responsibility: You are solely responsible for ensuring the accuracy, completeness, and value of the data you enter. We highly recommend maintaining separate, official documentation, receipts, and appraisals for your insurance provider. MaintFolio is not liable for any denied insurance claims resulting from incomplete or inaccurate data stored on our platform.

3. Maintenance, Safety, and "DIY" Disclaimer

Our Services may provide "Smart Tips," automated maintenance schedules, and links to Do-It-Yourself (DIY) tutorials based on generalized expert guidelines or AI-generated suggestions.

• Information Only: All maintenance recommendations are for informational purposes only and do not constitute professional advice.
• Assumption of Risk: Home repairs, automotive maintenance, and equipment servicing carry inherent risks of injury or property damage. You assume all risk and liability for any tasks you choose to perform.
• Verification: Always consult the original manufacturer’s manual, warranty guidelines, or a certified professional before beginning any maintenance task.

4. Third-Party Professionals & Vendor Network

MaintFolio may allow you to store contact information for, or be connected with, third-party service professionals (e.g., plumbers, mechanics, home organizers).

• Independent Entities: MaintFolio is solely a technology platform. We are not a service provider, general contractor, or employer of these professionals.
• No Endorsement or Liability: We do not guarantee the quality, safety, or legality of the work performed by any third party you connect with through MaintFolio. Any contracts, payments, or disputes are strictly between you and the service professional.

5. AI Features and Accuracy

MaintFolio utilizes Artificial Intelligence (AI) for features like the "Vision Scanner," "Inspection Upload," and "Smart Specs" to automate data entry.

Review Required: AI models can make errors (hallucinations or misread text). You agree that you are responsible for reviewing, verifying, and correcting any data (such as Serial Numbers, VINs, or Make/Model details) generated by our AI tools before saving them to your digital binder.

6. Financial Metrics and Estimates

Features within MaintFolio tracking "Total Cost of Ownership" (TCO) or "Upgrades/Improvements" are basic mathematical estimators based entirely on the data you input. They do not constitute financial, tax, or investment advice.

7. Data Privacy & B2B Sharing (For Professionals)

• Consumers: You own your data. If you accept a "Gifted Portfolio" from a Professional (e.g., a Realtor), you acknowledge that their branding and contact information will appear on your dashboard. However, they will not have access to your private data or edits unless you explicitly grant them permission.
• Professionals (B2B Users): If you use MaintFolio to create and transfer portfolios to your clients, you agree to comply with all applicable data privacy laws. You must obtain consent before uploading a client’s personal address or asset details to the platform for the purpose of a transfer.

8. Limitation of Liability

To the maximum extent permitted by law, MaintFolio and its founders, affiliates, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of your use of the Services, property damage, or physical injury.

9. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms, engage in illegal activities on the platform, or misuse our AI and storage infrastructure.
